Too many nonprofit managers view governance as a brake on the creativity and risk-taking that characterize American enterprise in general and the nonprofit sector in particular. But, in fact, good governance can engage legal, reputational, and other risks head-on and open up great mission-related opportunities for smart nonprofits. This session will explore how to manage risk through good governance practices — specifically looking at the expectations of, as well as the effect of such practices on, the principal regulators and overseers of nonprofit activities: the IRS; the state attorney general and other local regulators; dissenting directors or members and whistleblowers; and the media. William Klimon will identify the legal benefits of such practices and discuss how they can unlock programmatic possibilities.
