Session Description: Unrelated business income has emerged as a major topic in the ongoing examinations of colleges and universities currently underway. This session will focus on several key issues that can arise in such examinations:
1. Calculating UBIT and the double-edged sword of “profit motive”: How to tell if you have it, and whether you want it.
2. UBIT from payments between related organizations: section 512(b)(13).
3. Commercialization activities: How active a role can a university play in developing commercial applications of its technology (drug testing, building prototypes, etc.)? How can it keep its revenues safely characterized as research income or as royalties? Does it matter how the university’s technology transfer function is structured?
4. UBIT from investments: debt-financed income, foreign blocker corporations, and recent legislative developments.
5. UBIT on the web: hyperlinks, affiliate programs, podcasts, etc.
