Tax Notes Quotes Rachel Partain: Appeals Court Upholds IRS Voluntary Return Preparer Program

A federal appeals court rejected the American Institute of CPAs’ argument that the IRS’s voluntary tax return preparer program is unlawful, giving the IRS a major win in its efforts to increase oversight of unenrolled preparers.

Rachel L. Partain of Caplin & Drysdale, Chtd. said the decision is “a welcome one for the IRS, which has been trying for a long time to protect taxpayers from unscrupulous unenrolled tax return preparers.”

However, because the program is voluntary, the IRS still needs a legislative solution authorizing it to regulate all unenrolled tax return preparers, she said.
